In order to address the persisting issue of gun violence, the governor deems it essential to take decisive action, even in the face of potential legal challenges. Aiming to curb the prevalence of firearms-related incidents, the governor has implemented a temporary ban on both open and concealed carry in most public areas. This measure is classified as an emergency public health order and applies to all individuals, with the exception of police officers and licensed security guards. It is important to note that violating this order may result in civil penalties and fines of up to $5,000.
While Governor Lujan Grisham’s decision has drawn support from advocates for gun control, not all law enforcement officials are on board. Albuquerque Police Chief Harold Medina stated that his department won’t enforce the order, while Bernalillo County Sheriff John Allen expressed concerns about its potential impact on constitutional rights.
The governor emphasized the urgency of making New Mexicans safer and welcomed the debate surrounding the issue. However, implementing the order could create conflicts with the U.S. Department of Justice regarding a police reform settlement and raise questions about constitutional rights.
Governor Lujan Grisham referenced several recent shootings in Albuquerque to justify her decision, including a road rage shooting that killed an 11-year-old boy and critically injured a woman. The governor’s order also directs state regulators to increase inspections of firearms dealers and requires the compilation of a report on gunshot victims in New Mexico hospitals.
While the legal fate of the order remains uncertain, supporters believe that any measure to save lives from gun violence is worthwhile. The governor has previously signed multiple pieces of legislation aimed at restricting access to firearms in New Mexico.
